Can I get a home loan while on an ATO payment plan?

Short answer

Possibly. A payment plan is a debt you must declare, and lenders count its repayments, so the plan and the new loan must fit your budget together. Lender policies on tax debt vary and change. Credit reporting of business tax debt is not automatic: the ATO may disclose it only in limited cases, after written notice.

What lenders will want to see

  • The ATO may report a business tax debt to credit reporting bureaus only when set criteria are met, including the size and age of the debt and the business not effectively engaging with the ATO, for example through a payment plan. [ATO]
  • The ATO gives written notice before it discloses, and says the information is removed once the debt is paid or the business engages. [ATO]
  • General interest charge keeps accruing while a payment plan is in place, and you must keep lodging and paying new amounts on time or the plan can be cancelled. [ATO]
  • Lenders must make reasonable inquiries about your financial situation and take reasonable steps to verify it before lending. [ASIC]

Who this may suit

  • Self-employed borrowers who are keeping up with an ATO payment plan and current lodgments
  • Borrowers who can show the plan repayments and the new loan together fit their budget

Who it may not suit

  • Anyone who has missed plan repayments or has overdue lodgments: fix those first
  • Anyone hoping a new loan will hide the tax debt: it must be disclosed

Your options, including not borrowing

  • Keep paying the plan and apply later, once the debt is cleared or smaller. Not borrowing now is a valid choice.
  • Apply now, with full disclosure, to a lender whose current policy accepts an ATO payment plan. Policies vary by lender and change; we check current policy for your situation.
  • Ask the ATO about a different arrangement if the plan repayments are too high. [ATO]
  • Get advice on the tax debt itself from your accountant or tax agent.

Risks to weigh

  • Missing plan repayments can lead to the plan being cancelled. [ATO]
  • Interest on the tax debt keeps building while you also take on a new loan, which can squeeze cash flow. [ATO]
  • An application that leaves out a tax debt can be declined or cause problems later.

Next steps

  1. 1Download your ATO statement of account and the payment plan terms.
  2. 2Gather your latest lodged tax returns, recent BAS and business bank statements.
  3. 3Talk to a broker before applying, so only one well-matched application is made.

Common follow-up questions

Only in limited circumstances. The ATO says it may disclose a business tax debt to credit reporting bureaus when the debt is above a threshold it sets, has been overdue for a set period and the business is not effectively engaging with the ATO. It gives written notice first. Check the ATO disclosure page for the current criteria.
Entering and keeping to a payment plan is one of the ways the ATO lists as effectively engaging, which is one of its disclosure criteria. Check the ATO page for the rules that apply to your business.
No. Owing more than the threshold does not by itself mean the debt is reported. Disclosure only happens when all of the ATO criteria are met, and after notice.
